Terms of Service

OVERVIEW
This website, online store, and related services are operated by NISHACO LLC (“NishaCo,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your use of NishaCo’s website, online store, checkout, physical products, conversation materials, Explorer Hub, digital resources, and related services (collectively, the “Services”).
Our online store and certain commerce-related Services are powered by Shopify, which provides technology that enables us to offer products and process transactions.
By visiting our website, accessing or using the Services, or placing an order, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.
ELIGIBILITY
You must be legally able to enter into a binding agreement to place an order through the Services.
Although some NishaCo products are designed for use with children and teens, purchases should be completed by an adult or by someone with the permission of a parent or legal guardian.
PRODUCTS AND CONVERSATION RESOURCES
NishaCo offers conversation-based family products, including Critical Thinking Conversation Starters, along with related discussion guidance, digital activities, and optional companion resources.
Our card decks contain open-ended scenarios and questions intended to help parents, caregivers, educators, mentors, and other caring adults facilitate meaningful conversations with children and teens.
NishaCo products do not provide prescribed answers or determine whether a participant’s response is right or wrong. Adults should use their judgment when guiding conversations and deciding which topics are appropriate for the children, teens, families, or groups in their care.
Age ranges are recommendations intended to help customers select an appropriate product. Individual readiness, maturity, personal experiences, family preferences, and circumstances may vary.
NishaCo products and resources are intended for conversation, reflection, family engagement, exploration, and general informational purposes. They are not a substitute for medical, psychological, legal, financial, counseling, educational assessment, or other professional advice or services.
Adult participation, supervision, and guidance should be provided when appropriate.
PRODUCT INFORMATION
We make reasonable efforts to display product descriptions, images, colors, prices, contents, and availability accurately.
Actual product colors, packaging, or appearance may vary slightly because of device displays, printing, manufacturing, photography, or normal production differences.
We may correct errors, inaccuracies, or omissions and update product information when necessary.
PRICES AND PAYMENTS
Prices are displayed in United States dollars unless otherwise stated.
Prices, promotions, discounts, and product availability may change at any time before an order is completed.
Applicable shipping charges and taxes will be shown as applicable at checkout.
Payment must be successfully authorized before an order is accepted or fulfilled.
Payment processing may be provided by Shopify or other authorized payment providers. Your use of those payment services may also be subject to the applicable provider’s terms and privacy practices.
ORDERS
Submitting an order does not guarantee acceptance.
We may decline, cancel, or limit an order for reasons including:

If we cancel all or part of an order after payment has been successfully charged, we will issue a refund of the amount charged for the canceled portion of the order to the original payment method.
Customers are responsible for providing accurate contact, billing, and shipping information.
Please review your order information carefully before completing checkout.
INVENTORY AND AVAILABILITY
Products are available while supplies last.
An item appearing available on the website does not guarantee inventory until the order has been accepted and processed.
We may limit quantities purchased per customer, household, order, or transaction.
If availability changes after an order is submitted, we may contact you regarding an appropriate resolution, including cancellation or refund of the unavailable item.
SHIPPING
Orders are subject to the NishaCo Shipping Policy.
Delivery estimates are estimates only and are not guarantees. Carrier delays, weather, service disruptions, incorrect addresses, high-volume periods, and other events outside our reasonable control may affect delivery.
Customers are responsible for providing a complete and accurate shipping address.
RETURNS AND REFUNDS
Returns, replacements, cancellations, exchanges, and refunds are governed by the NishaCo Returns and Refunds Policy.
Please review that policy before making a purchase.
INTELLECTUAL PROPERTY
The NishaCo name, logos, trademarks, product designs, card content, scenarios, questions, illustrations, written materials, discussion guidance, downloadable resources, website content, Explorer Hub content, digital activities, graphics, and related materials are owned by or licensed to NishaCo and are protected by applicable intellectual-property laws.
Purchasing a NishaCo product does not transfer ownership of any intellectual property.
Unless NishaCo provides prior written permission, you may not:

Copy or reproduce NishaCo products or materials for resale

Republish card content, scenarios, questions, or digital resources

Upload NishaCo materials to public websites, shared drives, marketplaces, or commercial platforms

Modify NishaCo materials and present them as your own

Sell, license, sublicense, or distribute unauthorized copies

Use NishaCo content to create competing products

Remove copyright, trademark, or ownership notices

Use NishaCo intellectual property in a way that falsely suggests sponsorship, endorsement, or affiliation
PERMITTED USE
NishaCo products and accompanying resources may be used for personal and family use.
Educators, mentors, counselors, group leaders, and other facilitators may use a purchased product with the students, participants, or groups they directly teach, guide, counsel, mentor, or supervise, unless a separate license states otherwise.
Purchasing one product does not grant a school-wide, district-wide, organization-wide, resale, commercial-reproduction, or public-distribution license.
NishaCo cards and related resources may be used to facilitate discussion, but they may not be copied or distributed to participants except where NishaCo has expressly authorized a printable, downloadable, or shareable resource for that purpose.
EXPLORER HUB AND DIGITAL RESOURCES
Certain NishaCo products may include access to bonus digital resources through a printed QR code or related link.
Explorer Hub resources are intended to complement physical products with optional activities, guided exploration, discussion extensions, and family engagement experiences.
Explorer Hub content does not provide professional advice, individualized assessment, grades, scores, diagnoses, or guaranteed developmental outcomes.
Explorer Hub content, features, and resources may be updated, improved, replaced, temporarily interrupted, or discontinued when reasonably necessary for maintenance, security, legal compliance, operational reasons, or product improvement, subject to applicable law and any specific commitments made at the time of purchase.
You may not attempt to:

Interfere with or damage the Explorer Hub or related systems

Circumvent security or access controls

Gain unauthorized access

Introduce harmful code
-
Scrape or systematically extract protected content

Reverse engineer protected systems or functionality except where such restriction is prohibited by law

Misuse Explorer Hub content in violation of these Terms
NO GUARANTEED OUTCOMES
NishaCo products are designed to encourage conversation, reflection, communication, curiosity, connection, and the expression of ideas.
We do not guarantee that using a NishaCo product will produce a particular academic, behavioral, developmental, social, emotional, family, or other outcome.
Individual experiences may vary based on factors including participation, age, maturity, facilitation, personal circumstances, family dynamics, and frequency of use.
USER CONDUCT
You agree not to use the website, online store, checkout, products, digital resources, or other Services:

For unlawful, fraudulent, abusive, deceptive, or misleading purposes

To violate intellectual-property or other legal rights

To transmit malware, viruses, or harmful code

To interfere with website security, operation, or availability

To attempt unauthorized access to systems, accounts, or data

To collect information about others without authorization

To impersonate another person or organization

To make unauthorized or fraudulent purchases

To resell, reproduce, or publicly distribute NishaCo materials without permission

In any manner that violates these Terms or applicable law
THIRD-PARTY SERVICES
NishaCo may use third-party services for hosting, ecommerce technology, payments, checkout, shipping, analytics, communications, order management, fulfillment, and other business functions.
Shopify provides technology used to operate portions of our online store and checkout experience.
Your use of certain third-party services may also be subject to their applicable terms, policies, and privacy practices.
NishaCo is not responsible for independent third-party websites, platforms, or services that we do not own or control, except to the extent responsibility cannot legally be excluded.
PROMOTIONS AND DISCOUNTS
Promotions and discount codes may be subject to additional conditions, expiration dates, product exclusions, order minimums, quantity limits, or usage restrictions.
Unless expressly stated otherwise:

Promotions cannot be combined

Promotions have no cash value

Discounts cannot be applied retroactively to completed purchases
We may modify or discontinue promotions as permitted by law.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the website, Explorer Hub, digital resources, and related Services are provided on an “as available” basis.
We do not guarantee that the website, digital resources, or Services will always be uninterrupted, error-free, completely secure, or available on every device or network.
Product-specific warranties, if any, will be stated separately.
Nothing in these Terms excludes or limits any warranty, guarantee, right, or remedy that cannot lawfully be excluded or limited.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, NishaCo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the website, products, Services, or digital resources.
Where liability cannot legally be excluded, NishaCo’s liability will be limited only to the extent permitted by applicable law.
Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, portions of this section may not apply to you.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless NishaCo and its owners, employees, contractors, agents, and service providers from claims, losses, liabilities, damages, or reasonable expenses arising from:

This section does not apply to the extent prohibited by applicable law.
SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.
NO WAIVER
If NishaCo does not enforce a provision of these Terms at any particular time, that does not waive our right to enforce that provision later.
CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our products, Services, operations, business practices, or legal requirements.
The updated version will be posted with a revised effective date.
Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms where permitted by applicable law.
Material changes will be communicated when required by law.
GOVERNING LAW
These Terms are governed by the laws applicable in the State of Texas and applicable United States federal law, without regard to conflict-of-law principles.
However, this governing-law provision does not limit any consumer-protection rights or other mandatory rights you may have under the laws applicable to you.
